Court:  Small claims cases are heard in the Justice of the Peace Court.

Claim Limit:  $15,000.00

Answer Period:  Defendant must file an answer within 15 days of service in all debt or trespass claims to avoid default.

Attorney Representation: Delaware permits attorneys to represent clients in small claims court.

Eviction Cases:  Eviction cases are not allowed in small claims court.

Jury Trial:  Jury trials are not permitted in Iowa small claims court.

Statutes of Limitations  (Del. Code Ann. tit. 10, § 8101 et seq.):
– Written Contract:  3 years
– Oral Contract: 3 years
– Personal Injury: 2 years
– Real Property: 2 years
– Personal Property: 2 years
